KATHMANDU, JUN 21 – The Supreme Court on Thursday asked the government to explain the transfer of 24 senior police officers. The court was responding to a writ filed against the government’s June 18 move to transfer the officers.



A single bench of Justice Girish Chandra Lal has given the government 15 days to furnish a reply.

The bench, however, did not issue an interim order as sought by the petitioner. It argued that the election process has not begun yet.

Advocate Kamal Itani had moved the apex court on Wednesday, arguing that the Cabinet decision violated the code of conduct issued by the Election Commission (EC) and other constitutional provisions.

According to the EC code of conduct, a government that has announced elections cannot effect such transfers. The petitioner had also argued that the decision seemed “ill intended” and is likely to compromise with the idea of free and fair elections.

Although the EC had issued the code of conduct on June 6, the government went ahead with the transfers. In a letter to the Chief Secretary, the EC has ordered the government to rescind the decision.

The EC has also sought a clarification from the Home Ministry on the government’s decision to promote seven SSPs to DIGs of the Armed Police Force on June 7. The government has also promoted some high-ranking officials of the National Investigation Department.
