SC stays ban on packaging cements in un-laminated sacks
KATHMANDU, Aug 29: The Supreme Court (SC) on Wednesday stayed the government decision to mandatorily package cement in laminated sacks.
A single bench of Justice Kamal Narayan Das ordered the government not to implement the decision until the apex court passes the final verdict.
The SC said that the government could not take such a decision without introducing law and conducting study on environmental impact on the use of un-laminated sacks.
Narendra Dahal of Kathmandu-32 on Monday had filed a writ petition at the apex court urging to give continuity to package cements in un-laminated sacks made of polymer.
The petitioner has argued that the government decision would lead to closure of dozens of sack producing industries and capital flight of some Rs. 100 million annually. Similarly, the petitioner argued that the government´s decision would cause loss of employment of hundreds of peoples.
The Ministry of Environment, Science and Technology (MoEST) on May 28 published a notice in the gazette regarding mandatory use of laminated bags for cement.
The MoEST has argued that the use of un-laminated sacks was sub-standard practice as it caused seepage and inflicted net loss to consumers.republica
